When Should an Influencer Register as Self-Employed?

Oct 11, 2026

There's no fixed income amount that forces an influencer in Spain to register as self-employed (autónomo). The law doesn't set a billing threshold: what determines the obligation is whether your activity as a content creator is habitual, not how much you earn. Since early 2026, Spain's Supreme Court has reinforced that earning below the minimum wage (SMI) does not automatically exempt you from this obligation.

The minimum-wage myth that circulates among creators

For years, the common belief was that if you stayed under the annual minimum wage, you could keep accepting brand deals without registering. That idea came from older case law, but a February 2026 Supreme Court ruling clarified the criteria: earning less than the minimum wage can be an indication to weigh, but it's never an automatic exemption. What really matters is whether you repeat collaborations continuously, even if each one pays little.

What counts as habitual activity for an Instagrammer or TikToker?

Tax and social security authorities usually look at several factors together, not just one:

  • Frequency: do you work with brands every month, or just once a year?
  • Continuity: have you been receiving payments or valuable gifts for several quarters?
  • Organization: do you have a rate card, media kit, or a steady pipeline of brand proposals?
  • Number of clients: one occasional brand is not the same as several recurring agencies.

If this sounds like your situation, it's worth reviewing the basics of tax obligations for content creators before deciding whether it's time to formalize your status.

Tax registration (modelo 036/037) vs. self-employed social security registration (RETA)

These are two separate procedures, and it's important not to mix them up:

  • Tax registration (modelo 036 or 037): mandatory as soon as you start billing for an economic activity, however small. Without it, you can't legally issue invoices.
  • RETA registration (modelo TA.0521): mandatory once the activity becomes habitual. It must be filed within 60 days before the activity starts.

Many creators register for tax purposes so they can invoice, but delay the self-employed social security registration thinking "it's not time yet." If social security authorities decide the activity was already habitual, they can backdate the registration.

What can happen if you delay registration

  • Backdated contributions plus surcharges, calculated from the real start date of the activity.
  • Loss of the reduced flat-rate contribution if requested too late.
  • Tax penalties for issuing invoices without being properly registered.

Staying ahead without losing track of your income

The key is not waiting for the tax office to ask. Keeping a clear record of which brands pay you, how much, and how often helps you spot the moment your activity stops being occasional. A brand-by-brand and campaign income record lets you see at a glance whether your collaborations already show the continuity that triggers self-employment registration, including valued brand gifts. Once you're registered, you can use Influx to prepare each invoice's data with estimated VAT and income tax before passing it to your accountant, who will issue the official invoice.

Frequently asked questions

Can I invoice a brand without being registered as self-employed? No. To legally issue invoices you need, at minimum, tax registration (modelo 036/037), even for a one-off collaboration.

Does earning below the minimum wage exempt me from social security registration? Not automatically. Spain's Supreme Court clarified in 2026 that the minimum wage is only an indication; what matters is whether your activity is habitual, continuous and organized.

What happens if the tax office finds out I should have registered earlier? They can backdate your registration and claim unpaid contributions or surcharges from the date your habitual activity actually started.

Does a single product gifting deal with one brand force me to register? If it's an isolated event with no continuity, it's usually treated as occasional activity, but it's worth documenting it and confirming with your accountant.
